On July 7, 2025, the SAKG team of Jeff Kennard, Alex McKenna, and Faith Collins obtained a $3.88 million jury verdict in Jackson County for our client, RM Mechanical, Inc. (“RM”).
RM, an Idaho-based mechanical contractor, sought to recover the unpaid contract balance, which totaled roughly $5.48 million, for work it performed in connection with the construction of the new Trinity Health Hospital in Minot, North Dakota . The defendant, US Engineering Innovations (“USEI”), which is based in Kansas City, contended it was entitled to offset the entire unpaid contract balance and recover an additional $2.56 million from RM due to its alleged failure “to perform diligently and in a workmanlike manner.”
After a five-day jury trial, the jury awarded RM the entire $5.48 million unpaid contract balance and awarded $1.6 million to USEI on its counterclaim, thus resulting in a net verdict of $3.88 million in RM’s favor. After filing but before receiving a ruling on RM’s post-trial motions seeking more than $1.6 million in interest and attorney’s fees, the case was resolved for substantially more than the net verdict amount.
