The plaintiff, a minor, was delivered by cesarean section on February 18, 2019. Plaintiff claimed that during the delivery, performed by the Defendant OB/GYN, the child suffered a severe laceration to the eyelid, canalicular system, and conjunctiva through the Defendant’s negligent use of a scalpel while making entry into the mother’s uterus. Plaintiff alleged excessive force was used while making the incision, and the Defendant erred in entering the uterus with a scalpel, rather than in a blunt fashion. Permanent and progressive scarring and disfigurement were alleged.
SAKG’s team, which was headed by lead counsel Todd Scharnhorst, secured a unanimous defense verdict.
