SAKG Achieves Defense Verdict in FELA Wrongful Death Case in Wyandotte County, Kansas
On February 1, 2018, Jim Griffin along with co-counsel William Floyd and Randy Jordan obtained a defense verdict in a FELA wrongful death case in the District Court of Wyandotte County, Kansas.
The plaintiff claimed her husband was exposed to asbestos and diesel fumes which caused him to develop lung cancer. The decedent was a smoker and, therefore, the defense argued that his lung cancer was caused by smoking. The jury found the decedent to be 87% at fault with gross damages of $500,000. The net recovery to plaintiff was $65,000. Because the plaintiff had previously settled with several asbestos settlement trusts for a total of more than $65,000, the trial judge ordered a credit in the amount of the settlement resulting in a defense verdict.
