SAKG Achieves Unanimous Defense Verdict in Cass County, Missouri
Jeff Kennard and Todd Scharnhorst achieved a unanimous defense verdict in a pharmacy malpractice case in the Circuit Court of Cass County, Missouri.
The plaintiff alleged SAKG’s client failed to fill a prescription following gastrointestinal surgery, resulting in surgical site failure, a near-fatal bleed, and the need for emergent operative invention. The patient later required a Roux-en-Y gastrojejunostomy. Plaintiff’s theory was propounded and supported by her treating surgeon, who also served as plaintiff’s expert. SAKG’s client acknowledged the prescription was not filled because plaintiff’s insurance company rejected the prescription, but disputed the lack of medication caused the surgical site failure. The jury agreed and returned a unanimous defense verdict in less than 30 minutes.
