SAKG Obtains Summary Judgment in Employment Case in the Western District of Texas
An SAKG team of Brent Coverdale and Cameron Grant obtained summary judgment dismissing racial, sexual and disability discrimination claims against a national Kansas City employer. The District Court of the Western District of Texas found the plaintiff’s sexual harassment claims were untimely, that she failed to identify similarly-situated individuals in support of her disparate pay and wrongful termination claims, that there was no causal connection between her alleged reporting of discrimination and her termination, and that her alleged migraines did not constitute a disability that would support an ADAAA claim. The Court further found that even if the plaintiff had made a prima facie case, the company established a non-pretextual, permissible basis for terminating the plaintiff’s employment as part of a reduction in force.
