Results

- Successfully litigated two related catastrophic birth injury cases involving labor and delivery. Plaintiff alleged the provider failed to timely recognize fetal distress and further that the hospital failed to take adequate care in the credentialing of physicians. After extensive litigation the cases were resolved favorably.
- Received a unanimous defense verdict in a case alleging an exacerbation of an orthopedic injury after a fall on an icy parking lot requiring surgical intervention.
- Served as lead counsel through federal trial and received a favorable result in a case alleging a failure to identify a foot infection which lead to an amputation. After extensive discovery and expert testimony, the case was presented to the jury. Plaintiff alleged that the infection was missed at the time of the initial emergency department visit. The Defendants were able to show that the infection leading to the amputation was a result of a different bacteria than what was initially present at the initial visit. Ultimately, the jury had sympathy for the plaintiff, but their verdict resulted in a result that was substantially lower than the last pretrial demand.
- Served on a trial team obtaining a defense verdict in a case where Plaintiff alleged that a failure to diagnose fetal distress led to a catastrophic brain injury. The jury heard evidence that the child’s condition developed well before birth and returned a unanimous defense verdict for the doctor and hospital.

- After extensive briefing and argument, obtained a favorable opinion from the Missouri Supreme Court relating to the scope of discovery in cases challenging decisions by the Missouri Department of Health and Senior Services in their denial of applicant licenses.
