Transportation

We have extensive experience and enjoyed considerable success representing transportation providers – including national railroads, national and regional motor carriers, and private carriers – in a variety of matters, including:

  • Federal Employers Liability Act (FELA) claims
  • Grade crossing and trespasser accidents
  • Commercial vehicle crashes including tractor/trailers, intermodal equipment, rollovers, and fires
  • Commercial disputes and freight claims
  • Federal and state regulatory compliance
  • Whistleblower claims

Often our clients have complex business organizations involving numerous business units or subdivisions which necessitate skilled communications regarding claims and litigation. Ultimately, our goal is to keep decision makers apprised of important developments and prevent surprises in the matters we handle.

Transportation Litigation Results

The following are a few examples of our recent experiences and successes:

  • Successfully defended multiple FELA actions brought against national railroad.
  • Successfully defended railroad contractor at intermodal terminal following crush injury and traumatic amputation of drayman’s fingers when a freight container fell on him during inspection.
  • Successfully defended property owners in railroad crossing cases involving death and significant personal injuries.
  • Retained by corporate transportation department within hours of interstate crash in which tractor trailer struck from behind a disabled minivan with family of six on Missouri interstate highway.  After managing and resolving pre-suit claims of five less-injured occupants, successfully tried minor child’s claims for permanent traumatic brain injury to jury.
  • Successfully defended major beverage company in wrongful death action arising from collision between delivery truck and vehicle carrying family with young children at rural county highway intersection.
  • Represented construction contractor and obtained summary judgment in case arising from rear-end collision between truck and passenger vehicle in which one of the occupants suffered devastating neurologic injuries, including quadriplegia.
  • Defended trucking company in personal injury case involving rear-end collision on Kansas highway in which the parties litigated whether the driver was acting within the course and scope of his employment.
